Terms of Use

These Terms of Use (“Terms”) govern your use of the BidNest mobile application and services. By using BidNest, you agree to these Terms.

If you do not agree, do not use the app.

1. License to Use the App

We grant you a limited, non-exclusive, non-transferable license to use BidNest for personal or business purposes in accordance with these Terms.

You may not:

  • Reverse engineer the app

  • Copy or resell the software

  • Use the app for unlawful purposes

  • Attempt to bypass security features

2. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your login

  • All activity under your account

  • Providing accurate information

We reserve the right to suspend accounts that violate these Terms.

3. Subscriptions

Auto-Renewable Subscription

BidNest offers subscription plans that automatically renew.

  • Payment is charged to your Apple ID at confirmation of purchase

  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage or cancel subscriptions in your Apple account settings

Free Trial

If offered:

  • Any unused portion of a free trial will be forfeited when purchasing a subscription

4. User Content

You retain ownership of content you upload (images, listings, descriptions).

By uploading content, you grant BidNest a limited license to:

  • Process content for AI cataloging

  • Display listings within the app

  • Improve service functionality

You agree not to upload unlawful or infringing content.

5. AI Features Disclaimer

AI-generated cataloging and descriptions are provided for convenience. We do not guarantee accuracy. Users are responsible for reviewing and verifying all listing information.

6. Service Availability

We may modify, suspend, or discontinue parts of the service at any time without liability.

7. Limitation of Liability

To the maximum extent permitted by law, BidNest shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits or data

  • Errors in AI-generated content

  • Auction outcomes or third-party transactions

8. Termination

We may terminate or suspend access if you violate these Terms.

You may stop using the app at any time.

9. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
